1. Introduction

Welcome to Alburaaq Freight. These Terms and Conditions govern your use of our freight forwarding, logistics, and related services. By engaging our services, you agree to be bound by these terms.

Alburaaq Freight operates as an international freight forwarder and logistics provider, offering services including but not limited to air freight, sea freight, road transport, warehousing, customs clearance, and procurement services.

2. Service Agreement

2.1 Scope of Services

Alburaaq Freight provides freight forwarding and logistics services as an intermediary. We arrange transportation through third-party carriers and service providers. Our services include:

  • International and domestic freight forwarding
  • Air, sea, road, and rail transportation arrangements
  • Customs clearance and documentation
  • Warehousing and storage solutions
  • Procurement and trading services
  • Cargo consolidation and deconsolidation

2.2 Client Responsibilities

Clients must provide accurate information regarding cargo, including weight, dimensions, value, and contents. Clients are responsible for proper packaging, labeling, and compliance with all applicable regulations and export/import requirements.

3. Liability and Insurance

3.1 Limitation of Liability

As a freight forwarder, Alburaaq Freight acts as an agent in arranging transportation and related services. Our liability is limited to the terms set forth in the applicable conventions, including but not limited to the Warsaw Convention (air freight), Hague-Visby Rules (sea freight), and CMR Convention (road transport).

3.2 Insurance

Cargo insurance is not automatically included in our services. Clients are strongly advised to arrange comprehensive cargo insurance. Alburaaq Freight can facilitate cargo insurance arrangements upon request.

3.3 Claims

Any claims for loss or damage must be notified in writing within 7 days of delivery or scheduled delivery date. Claims must be accompanied by supporting documentation including invoices, packing lists, and photographic evidence where applicable.

4. Payment Terms

4.1 Charges and Fees

All charges are based on quotations provided and are subject to change based on actual weight, dimensions, route, and additional services required. Clients will be notified of any variations before services are rendered.

4.2 Payment Terms

Unless otherwise agreed in writing, payment terms are 30 days from invoice date. Late payments may incur interest charges at the prevailing commercial rate.

4.3 Lien Rights

Alburaaq Freight reserves the right to retain cargo as security for payment of all outstanding charges, including storage fees, until full payment is received.

5. Customs and Regulatory Compliance

5.1 Customs Clearance

When instructed to arrange customs clearance, Alburaaq Freight acts as the client's agent. Clients are responsible for providing accurate information and documentation required for customs purposes.

5.2 Prohibited Goods

Clients must not tender goods that are prohibited or restricted under applicable laws and regulations. This includes but is not limited to dangerous goods (unless properly declared and approved), illegal substances, counterfeit goods, and items subject to trade sanctions.

5.3 Duties and Taxes

All duties, taxes, and other charges imposed by customs or other authorities are the responsibility of the client. Alburaaq Freight may advance such charges on the client's behalf and will invoice accordingly.

6. Force Majeure

Alburaaq Freight shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, civil unrest, strikes, natural disasters, pandemics, government actions, or carrier delays.

7. Data Protection and Privacy

Alburaaq Freight is committed to protecting client data in accordance with applicable data protection laws. Personal and business information provided to us will be used solely for the purpose of providing our services and will not be disclosed to third parties except as necessary to fulfill our obligations or as required by law.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

9. Amendments

Alburaaq Freight reserves the right to amend these Terms and Conditions at any time. Amendments will be effective immediately upon posting on our website. Continued use of our services after amendments constitutes acceptance of the revised terms.
